TERMS AND CONDITIONS
Terms and Conditions for Accommodation Contracts
These Terms and Conditions govern accommodation contracts between guests and the accommodation facilities operated by TEJ Co., Ltd. ("the Company"), including ELE Hotel and ELE Hotel Cabin ("the Hotel"). For matters specific to each property, such as check-in and check-out times, please refer to each hotel's page on this website or the information provided at the property.
Article 1 (Scope of Application)
1. Accommodation contracts and related contracts concluded between the Hotel and its guests shall be subject to these Terms and Conditions. Any matters not provided for herein shall be governed by laws and regulations or generally established practices.
2. Notwithstanding the preceding paragraph, if the Hotel agrees to a special contract insofar as it does not violate laws, regulations or established practices, the special contract shall take precedence.
Article 2 (Application for Accommodation Contracts)
1. Any person who wishes to apply for an accommodation contract with the Hotel shall provide the Hotel with the following information:
(1) Name of the guest(s)
(2) Date of accommodation and estimated time of arrival
(3) Accommodation charges (in principle, the basic accommodation charges listed in Attached Table No. 1)
(4) Other information deemed necessary by the Hotel
2. If a guest requests, during the stay, to extend the stay beyond the date specified in item (2) of the preceding paragraph, the Hotel shall regard such request as a new application for an accommodation contract at the time the request is made.
Article 3 (Conclusion of Accommodation Contracts)
1. An accommodation contract shall be deemed to have been concluded when the Hotel accepts the application set forth in the preceding Article; provided, however, that this shall not apply if it is proved that the Hotel did not accept the application.
2. When an accommodation contract has been concluded in accordance with the preceding paragraph, the guest shall pay, by the date specified by the Hotel, an advance payment set by the Hotel within the limit of the basic accommodation charges for the period of stay (or for three days if the stay exceeds three days).
3. The advance payment shall first be applied to the accommodation charges ultimately payable by the guest, and, if circumstances arise to which Articles 6 and 18 apply, then to cancellation charges and to compensation for damages, in that order. Any balance shall be refunded at the time of payment of charges under Article 12.
4. If the guest fails to pay the advance payment set forth in paragraph 2 by the date specified by the Hotel, the accommodation contract shall lose its effect; provided, however, that this shall apply only if the Hotel has informed the guest to that effect when specifying the payment date.
5. For reservations made through online travel agencies, travel agents or the like, prepayment and advance payment shall be handled in accordance with the rules of such agencies.
Article 4 (Special Contracts Requiring No Advance Payment)
1. Notwithstanding paragraph 2 of the preceding Article, the Hotel may agree to a special contract under which no advance payment is required after the conclusion of the contract.
2. If, upon accepting an application for an accommodation contract, the Hotel does not request the advance payment set forth in paragraph 2 of the preceding Article or does not specify a payment date for it, the Hotel shall be deemed to have agreed to the special contract set forth in the preceding paragraph.
Article 5 (Refusal to Conclude Accommodation Contracts)
The Hotel may refuse to conclude an accommodation contract in the following cases:
(1) When the person seeking accommodation is a patient or the like of a specified infectious disease as defined in the Hotel Business Act.
(2) When the person seeking accommodation is deemed likely to engage in gambling or other illegal acts, or in acts contrary to public order and morals.
(3) When the person seeking accommodation is deemed to be a member of an organized crime group, an organized crime group member, a quasi-member or an associate thereof as defined in the Act on Prevention of Unjust Acts by Organized Crime Group Members, or any other anti-social force.
(4) When the person seeking accommodation repeatedly makes demands of the Hotel that are specified by laws and regulations as demands whose fulfillment would impose an excessive burden and would be likely to significantly hinder the provision of accommodation services to other guests (specified demands).
(5) When there are no available rooms.
(6) When the Hotel is unable to provide accommodation due to natural disasters, malfunction of facilities or other unavoidable reasons.
(7) When the case falls under the provisions of prefectural ordinances.
Article 6 (Right of Guests to Cancel Contracts)
1. Guests may cancel an accommodation contract by notifying the Hotel.
2. If a guest cancels all or part of an accommodation contract for reasons attributable to the guest (except where the Hotel has specified a payment date and requested the advance payment under paragraph 2 of Article 3, and the guest cancels the contract before making that payment), the Hotel shall charge a cancellation fee as set forth in Attached Table No. 2. However, if the Hotel has agreed to the special contract under paragraph 1 of Article 4, this shall apply only if the Hotel informed the guest of the obligation to pay a cancellation fee in case of cancellation when agreeing to the special contract.
3. If a guest does not arrive by the check-in closing time set by each hotel on the date of stay (or, if an estimated time of arrival has been specified in advance, two hours after that time) without notifying the Hotel, the Hotel may regard the accommodation contract as having been cancelled by the guest.
Article 7 (Right of the Hotel to Cancel Contracts)
1. The Hotel may cancel an accommodation contract in the following cases:
(1) When the guest is a patient or the like of a specified infectious disease as defined in the Hotel Business Act.

(3) When the guest is deemed to be an anti-social force as defined in item (3) of Article 5.
(4) When the guest repeatedly makes specified demands as defined in item (4) of Article 5.
(5) When the Hotel is unable to provide accommodation due to natural disasters or other force majeure.
(6) When the case falls under the provisions of prefectural ordinances.
(7) When the guest fails to observe prohibited matters set forth in the Hotel's usage rules, such as smoking in guest rooms (including heated tobacco and electronic cigarettes) or tampering with fire-fighting equipment.
2. If the Hotel cancels an accommodation contract in accordance with the preceding paragraph, the Hotel shall not charge for any accommodation services that the guest has not yet received.
Article 8 (Registration)
1. On the day of arrival, guests shall register the following information at the Hotel's front desk or at a self check-in terminal designated by the Hotel:
(1) Name, address and contact information of the guest

(3) Other information deemed necessary by the Hotel
2. If a guest intends to pay the charges under Article 12 by a method other than cash, such as a credit card, the guest shall present it in advance at the time of registration under the preceding paragraph.
Article 9 (Room Usage Hours)
1. Guests may use their rooms from the check-in time to the check-out time on the following day, as set by each hotel (shown on each hotel's page). However, for consecutive stays, guests may use the room all day except on the days of arrival and departure.
2. Notwithstanding the preceding paragraph, the Hotel may permit use of a room outside the hours set forth therein. In such cases, an additional charge set by each hotel will apply.
Article 10 (Compliance with Usage Rules; Non-Smoking Policy)
1. While on the Hotel premises, guests shall comply with the usage rules established by the Hotel and posted within the Hotel or on its website.
2. All guest rooms are non-smoking (including heated tobacco and electronic cigarettes). If a guest smokes in a guest room, the Hotel may charge the actual costs of deodorizing and cleaning and any loss arising from the room being unavailable for sale.
Article 11 (Business Hours)
1. The business hours of the front desk, breakfast area, coin laundry and other facilities are announced on each hotel's page and in the information provided at the property.
2. The hours set forth in the preceding paragraph may be changed temporarily when necessary and unavoidable. In such cases, guests will be notified by appropriate means.
Article 12 (Payment of Charges)
1. The breakdown of accommodation charges and other charges payable by guests shall be as set forth in Attached Table No. 1.
2. Accommodation charges and other charges under the preceding paragraph shall be paid in cash or by an alternative method accepted by the Hotel, such as a credit card, electronic money or QR code payment, at the front desk (including self check-in terminals) upon the guest's arrival or when requested by the Hotel. This does not apply if payment has already been made in advance through an online booking site or the like.
3. Accommodation charges shall be payable even if the guest voluntarily does not stay after the Hotel has provided the room and made it available for use.
Article 13 (Liability of the Hotel)
If the Hotel causes damage to a guest in the performance or non-performance of an accommodation contract or related contracts, the Hotel shall compensate for such damage; provided, however, that this shall not apply if the damage is not attributable to the Hotel.
Article 14 (Handling When Contracted Rooms Cannot Be Provided)
1. If the Hotel is unable to provide the contracted room to a guest, the Hotel shall, with the guest's consent, arrange for other accommodation under conditions as similar as possible, including other hotels operated by the Company.
2. Notwithstanding the preceding paragraph, if the Hotel is unable to arrange other accommodation, the Hotel shall pay the guest compensation equivalent to the cancellation fee, which shall be applied to the amount of damages. However, if the inability to provide a room is not attributable to the Hotel, no compensation shall be paid.
Article 15 (Handling of Deposited Articles)
1. If articles, cash or valuables deposited by a guest at the front desk are lost, damaged or otherwise harmed, the Hotel shall compensate for such damage unless it was caused by force majeure. However, for cash and valuables, if the Hotel requested the guest to declare their type and value and the guest failed to do so, the Hotel's liability shall be limited to 150,000 yen.
2. If articles, cash or valuables brought into the Hotel by a guest but not deposited at the front desk are lost, damaged or otherwise harmed due to the intent or negligence of the Hotel, the Hotel shall compensate for such damage. However, for items whose type and value were not declared by the guest in advance, the Hotel's liability shall be limited to 150,000 yen unless the damage was caused by the Hotel's intent or gross negligence.
Article 16 (Custody of Guests' Baggage and Belongings)
1. If a guest's baggage arrives at the Hotel before the guest, the Hotel shall take responsibility for its custody only if the Hotel agreed to this before its arrival, and shall hand it over to the guest at check-in.
2. If a guest's baggage or belongings are found left at the Hotel after the guest has checked out and the owner is identified, the Hotel shall contact the owner and ask for instructions. If no instructions are given by the owner or the owner cannot be identified, the Hotel shall keep the items for seven days including the day of discovery and then hand them over to the nearest police station. Food, drink, magazines and other items unsuitable for storage may be disposed of at the Hotel's discretion.
3. The Hotel's liability for the custody of guests' baggage or belongings in the cases of the preceding two paragraphs shall be in accordance with paragraph 1 of the preceding Article in the case of paragraph 1, and with paragraph 2 of the same Article in the case of the preceding paragraph.
Article 17 (Liability for Parking)
When a guest uses the Hotel's parking lot (including partner parking lots introduced by the Hotel), the Hotel only provides the parking space and shall not be responsible for the management of the vehicle, regardless of whether the vehicle key has been deposited with the Hotel. However, the Hotel shall be liable for damage caused by its intent or negligence in managing the parking lot. The terms of use of partner parking lots shall be governed by the rules of the respective parking lot.
Article 18 (Liability of Guests)
If the Hotel suffers damage due to the intent or negligence of a guest, the guest shall compensate the Hotel for such damage.

Article 20 (Governing Law, Jurisdiction and Prevailing Language)
1. Accommodation contracts and these Terms and Conditions shall be governed by and construed in accordance with the laws of Japan.
2. Any dispute arising in connection with an accommodation contract or these Terms and Conditions shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the location of the Company's head office as the court of first instance.
